Terms of service

Section 1 - Access and Account

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage. You must provide correct information and maintain the security of your account. Account transfers are prohibited.

Section 2 - Our Products

We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration. Product descriptions are subject to change and discontinuation at our discretion.

Section 3 - Orders

Your order is not accepted until High End Dubai confirms acceptance. We must receive and process your payment before your order is accepted. Orders may be declined for any reason. Cancellations after acceptance may not be accommodated. All purchases must be for personal use, not commercial resale.

Section 4 - Prices and Billing

The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. You warrant that the credit card information you provide is accurate and that you are authorized to use it.

Section 5 - Shipping and Delivery

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Title and risk of loss pass to the buyer upon transfer to the carrier.

Section 6 - Intellectual Property

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, are protected by U.S. and foreign patent, copyright and other intellectual property laws. The Services are for personal, non-commercial use only. Unauthorized reproduction is prohibited.

Section 7 - Optional Tools

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind. We have no liability arising from or relating to your use of optional third-party tools.

Section 8 - Third-Party Links

We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. You assume all risk when accessing external links.

Section 9 - Relationship with Shopify

High End Dubai is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with High End Dubai. Shopify is expressly released from all liability related to these transactions.

Section 10 - Privacy Policy

All personal information we collect through the Services is subject to our Privacy Policy and Shopify's policies. Information may be shared with third parties potentially located in other countries.

Section 11 - Feedback

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose. You warrant that you own all rights to your Feedback and that it complies with these terms.

Section 12 - Errors, Inaccuracies and Omissions

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice.

Section 13 - Prohibited Uses

You may not access or use the Services for any unlawful purpose, to infringe intellectual property rights, to harass or abuse others, to transmit malicious code, or to engage in spam, phishing, or scraping activities.

Section 14 - Termination

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Specific provisions survive termination.

Section 15 - Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED BY High End Dubai, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND. We make no guarantees regarding accuracy, uninterrupted access, or error-free operation.

Section 16 - Limitation of Liability

IN NO CASE SHALL High End Dubai BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND. This exclusion applies even if we were advised of the possibility of such damages.

Section 17 - Indemnification

You agree to indemnify us for breaches of these terms, legal violations, or third-party claims arising from your use of the Services.

Section 18 - Severability

If any provision of these terms is found to be unlawful or unenforceable, that provision is severable and the remaining provisions remain enforceable to the maximum extent permitted by law.

Section 19 - Waiver; Entire Agreement

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us. Our failure to exercise any right does not constitute a waiver of that right.

Section 20 - Assignment

You may not transfer your rights under these terms without our written consent. We may assign our rights freely.

Section 21 - Governing Law

These terms are governed by the federal and state or territorial courts where High End Dubai is headquartered.

Headings are for convenience only and do not limit or otherwise affect these terms.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. Your continued use of the Services constitutes acceptance of those changes.
